These Terms and Conditions (Terms) govern your access to and use of our website, Platform, and all services we offer, including facilitation of patient-requested pathology testing services, result interpretation, health scoring, and online consultations (collectively, the ‘Services’). These Terms form a binding legal agreement between you and Optimastasis.
These Terms must be read together with our Privacy Policy, which is incorporated into these Terms. If there is any conflict between these Terms and our Privacy Policy, these Terms prevail in relation to the Services and the Privacy Policy prevails in relation to the handling of personal information. Our Privacy Policy is available at www.optimastasis.com.au, and we will provide you with a copy of our Privacy Policy on request.
By visiting our website, creating an account, placing an order, or otherwise using our Services, you accept these Terms in full. If you do not agree to these Terms, you must not use our Services.
We may update these Terms from time to time. For material changes, we will give you at least 30 days' notice by email and prominent notice on our website. Your continued use of our Services after that notice period constitutes acceptance.
Optimastasis operates a digital platform through which you can order patient-requested pathology testing services. The pathology component — specimen collection, laboratory analysis, and preparation of test results — is performed exclusively by Healius Pathology Pty Ltd (ACN 007 190 043) and its associated brands, including QML Pathology in Queensland (Healius), as our independent subcontractor.
Through our Platform, we provide:
Our services are not a substitute for medical advice, diagnosis, or treatment. Do not use our services in an emergency. If you have a medical emergency, call 000 immediately.
Our Services do not include medical consultations (beyond result discussion consultations), clinical diagnoses, treatment recommendations, prescriptions, medical certificates, management of acute or complex medical conditions, or any Medicare-rebatable service.
Our pathology test results, interpretations, and health scoring are not a medical diagnosis. They are provided for educational and informational purposes to help you understand your results and facilitate discussions with your healthcare provider.
Our Platform provides result interpretation and health scoring based on your pathology results. This content is prepared manually by our qualified, AHPRA-registered medical team. No artificial intelligence is used to generate interpretations or health scores that are provided directly to you. All content is reviewed and approved by a qualified medical practitioner before it is made available in your dashboard.
Result interpretation and health scoring are educational tools. They do not constitute medical advice and must not be used as the sole basis for any healthcare decision. You must discuss your results with a qualified healthcare professional who has knowledge of your complete medical history.
Where you choose to book an online consultation to discuss your results, you will be connected with a qualified medical practitioner. Online consultations are privately funded and are not Medicare-rebatable. The practitioner will provide advice based on your results and the information you provide during the consultation. Consultations are not a substitute for ongoing care from your regular general practitioner.
Healius performs the pathology component of our Services as our independent subcontractor. Healius is not a partner, agent, or affiliate of Optimastasis. We are solely responsible for delivering your results, result interpretation, health scoring, and all clinical follow-up. After Healius has provided results to us, all responsibility for your clinical care transfers to Optimastasis.
You acknowledge and agree that:
To access our Services, you must create an account. Guest ordering is not available — all orders are managed through your secure account. When creating an account, you must provide accurate, complete, and current information including your legal name, date of birth, and email address.
You are solely responsible for maintaining the security of your account credentials. You must not share your username or password with any other person. You are responsible for all activity that occurs under your account. If you become aware of any unauthorised access, notify us immediately at info@optimastasis.com.au.
We may suspend or terminate your account if you breach these Terms, provide false information, or use our Services in a manner that is harmful or unlawful.
Standard customers pay per order and receive access to their pathology test results through the dashboard. Standard accounts do not include result interpretation, health scoring, longitudinal tracking, or other Premium features.
Premium membership is available by subscription and unlocks additional features including result interpretation, health scoring, longitudinal tracking, trend analysis, and other features as published on our Platform. Premium membership is billed on the cycle selected at the time of subscription. Pricing is published on our Platform and may be updated from time to time with 30 days' notice.
You may cancel your Premium subscription at any time. Cancellation takes effect at the end of your current billing cycle. No partial refunds are provided for unused portions of a billing period. Your account will revert to Standard access upon cancellation.
Before you can complete an order for any test, our Platform will display clinical information about that test — what it measures, its clinical relevance, and the implications of potential results. You must acknowledge that you have read and understood this information before your order can proceed.
Where a test is classified as potentially notifiable under Australian public health law, you will be shown a specific notification before completing your order and asked to give your explicit consent. If you do not consent, the order for that test cannot proceed.
Once your order is confirmed and payment received, we will generate a Request Form for you to take to an Approved Pathology Collection Centre (ACC) operated by Healius. Request Forms are valid for six (6) months from the date of your order. If you present a Request Form after six months, we may require a supplementary fee equal to any increase in our cost of providing the service since your original order.
You must attend an ACC listed on the Healius website and available in a Contracted State under our agreement with Healius. Using a collection centre not listed on our Platform may result in additional charges, processing delays, or failure of your test.
All prices are displayed on our Platform in Australian dollars and include GST where applicable. Payment is required at the time of ordering. We use Stripe, a third party payment processor, to process payments securely (see stripe.com/au). We do not store your full payment card details. By placing an order, you warrant that you are authorised to use the payment method provided. By submitting your information for the purposes of paying your applicable fees, you consent to us providing the information to Stripe subject to our Privacy Policy.
Healius does not charge you directly for pathology services. You pay Optimastasis, and we pay Healius separately.
You may cancel your order within 30 days of placing it, subject to the following conditions:
To cancel, email info@optimastasis.com.au with your order details. Eligible refunds are processed to your original payment method within 7 business days.
Nothing in this cancellation policy limits any rights you may have under the Australian Consumer Law.
Where we operate a referral program, referral credits have an expiry period of six (6) months from the date of issue. Credits are non-transferable, cannot be exchanged for cash, and are subject to further terms published on our Platform at the time of issue.
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
For major failures with the Services, you are entitled:
You are also entitled to be compensated for any other reasonably foreseeable loss or damage where there is a major failure.
A ‘major failure’ includes where a reasonable consumer would not have acquired the Services if they had known the nature and extent of the problem, or the Services are substantially unfit for their normal purpose and cannot easily be made fit for such a purpose within a reasonable time, or the Services create an unsafe situation.
Where there is not a major failure with the Services, our liability for breach of any implied warranty or condition that cannot be excluded under the ACL is limited, at our option to:
If the failure does not amount to a major failure, you are entitled to have problems with the Services rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
To claim against us for breach of a consumer guarantee under the ACL you must provide us with written notice with documentary evidence substantiating the claim. Where we have assessed that you have a valid claim under the ACL, we will contact you and arrange a remedy.
Results are delivered exclusively through your secure account dashboard after you have logged in. Results are not emailed to you in full or delivered by any other method.
Premium members receive result interpretation and health scoring prepared by our qualified medical team. This content is educational and informational in nature. It is not a medical diagnosis and must not replace professional medical advice. You must discuss your results with a qualified healthcare professional who has knowledge of your complete medical history.
Where your results include a clinically significant, adverse, abnormal, or unexpected finding (as determined by Healius), our CMO or medical team will contact you directly to counsel you and manage any clinical response required. You must provide accurate contact details to ensure we can reach you.
You must never delay seeking medical advice, disregard professional medical advice, or discontinue medical treatment based on information provided through our Platform.
Where a test you are ordering is marked as potentially notifiable, our Platform will display a specific notification before you can complete your order. You must give your explicit consent before the order can proceed. Notification of notifiable conditions to public health authorities by Healius (as the performing laboratory) is a statutory requirement that cannot be opted out of. You may subsequently be contacted by a public health unit for follow-up or contact tracing.
Our Services are only available to persons aged 18 years and over. Our Platform automatically declines orders placed by or on behalf of any person under the age of 18. By placing an order, you confirm that you are 18 years of age or over.
By using our Services, you agree to:
All content on our website and Platform — including text, images, test descriptions, result interpretation frameworks, health scoring methodology, and software — is owned by or licensed to Optimastasis and is protected by Australian and international intellectual property laws. You may access and use this content solely for you to use the Services for your own personal, non-commercial use only.
You retain ownership of your personal information (including health information) and test results. By using our Services, you grant us a limited, non-exclusive, royalty-free licence to collect, use, store, and process such information for the purposes of providing our Services to you and complying with legal requirements for information retention as discussed in our Privacy Policy. This licence granted to us includes a right of sublicence to our third party subcontractors and service providers (as set out in these Terms) for the same purposes.
We collect, hold, use, and disclose your personal and health information in accordance with our Privacy Policy and all applicable privacy laws including the Privacy Act 1988 (Cth). Our Privacy Policy is available at www.optimastasis.com.au and is incorporated into these Terms.
You agree to comply with all applicable privacy laws when collecting and handling any personal information in connection with the Services.
In respect of any person/s other than you whose personal information you access or share using the Platform, you warrant that you have obtained all necessary consents to access or share this information under applicable privacy laws and this is otherwise in accordance with applicable privacy laws.
You must not share with any third party, copy or export any other person’s personal information externally from the Platform unless this is in accordance with applicable privacy laws, and you have obtained all necessary consents from each such person.
You acknowledge that the Services may use and integrate with software and systems provided by third parties (third party providers) to enable billing and payments and secure cloud storage of information in Australia, as related to the Services.
You acknowledge and agree that your personal information may be provided to these third party providers in accordance with our Privacy Policy and to the limited extent necessary for these third party providers to provide such functionality, and for us to provide the Services to you.
To the maximum extent permitted by law, our Services are provided on an 'as is' and 'as available' basis without warranties of any kind, except those that cannot be excluded under the Australian Consumer Law.
Healius performs all pathology testing as an independent subcontractor and is solely responsible for the accuracy of its testing procedures.
To the maximum extent permitted by law and subject to the Australian Consumer Law, we are not liable for and you release us from all liability (including in negligence), in respect of any losses, damages, injury to property or person, and costs incurred or suffered directly or indirectly in connection with:
To the maximum extent permitted by law and subject to the Australian Consumer Law, our total aggregate liability to you for any claims arising from or related to our Services is limited to the total amount you paid to us for the specific Services giving rise to the claim.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special loss or damage, including loss of profits, revenue, data, or business opportunity.
If you have a complaint about our Services, please contact us at info@optimastasis.com.au. We will acknowledge your complaint within 5 business days and work in good faith to resolve it. If we cannot resolve your complaint through direct communication within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre. Neither party may commence court proceedings without first attempting mediation, unless urgent injunctive relief is required. This Agreement is governed by the laws of Queensland.
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Optimastasis in relation to our Services and supersede all prior agreements and communications.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
We may assign or transfer our rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, or sale of assets. You may not assign your rights without our prior written consent.
